Welcome to CyanLens. These Terms of Service (“Terms”) govern your access to and use of services provided by CyanLens, LLC (“CyanLens,” “we,” “our,” or “us”), a digital marketing and video production agency headquartered at 100 Barber Ave, Worcester, MA 01606. By engaging with our services, you agree to be bound by these Terms.

2. Services Offered

CyanLens provides services including:

• Video production (commercials, brand content, documentaries)
• Marketing strategy and consulting
• Social media content and monthly subscription packages
• Website development and digital branding

Custom scopes are defined per project via proposals or service agreements.

3. Pricing and Payments

• All pricing is in U.S. Dollars (USD).
• Standard projects require a 50% deposit upfront, with the remaining 50% due upon delivery.
• Subscriptions and retainers are billed on a monthly basis, auto-renewing until canceled.
• Payments are securely processed via Stripe and other accepted payment methods.
• Invoices are due upon receipt unless otherwise specified.

Late Payment: A 5% monthly late fee may apply to overdue balances.

4. Refund Policy

Due to the customized nature of our services:

• All sales are final once work has begun.
• Deposits are non-refundable unless CyanLens cancels the project.
• Refund requests must be submitted in writing within 10 days of service delivery.

5. Cancellations & Rescheduling

• Cancellations made 7+ days before the production start date may be eligible for a partial refund (at CyanLens' discretion).
• Cancellations within 7 days are non-refundable and may incur a fee.
• Rescheduling is subject to availability and may require additional charges.

6. Delivery of Services

Deliverables are shared digitally. Estimated timelines will be included in your proposal. Delays due to client inaction (e.g., delayed feedback) may result in adjusted timelines or additional fees.

7. Ownership & Intellectual Property

• Final deliverables become client property upon full payment.
• CyanLens retains the right to showcase completed work in portfolios and promotional materials.
• Source files (e.g., project files, raw footage) remain the property of CyanLens unless otherwise agreed.

8. Client Responsibilities

You agree to:

• Provide timely feedback, content, and approvals
• Grant access to required locations or personnel
• Avoid using our services for unlawful or unethical content

9. Disclaimer & Limitation of Liability

CyanLens shall not be liable for:

• Indirect, incidental, or consequential damages
• Delays or failures caused by force majeure events
• Any liability exceeding the total project value paid

10. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes will be handled in courts located in Worcester County, MA.

11. Privacy & Data Protection

CyanLens complies with Massachusetts Data Security Regulations (201 CMR 17.00) and Stripe’s secure payment processing requirements. We never sell your data. For more, see our Privacy Policy.

12. Updates to Terms

CyanLens reserves the right to update these Terms. Material changes will be communicated via email or on our website. Continued use of our services after changes means you accept the new Terms.
